1. Acceptance of Terms
By entering or participating in this event, all athletes, spectators, and participants agree to the following terms, conditions, and waiver of liability. Completion of a registration form and/or purchase of an event ticket is deemed acceptance of these terms.
2. Acknowledgement of Risk
Participation in the Push Beyond Limits – HYROX Team Throwdown involves physical exertion and inherent risks, including but not limited to: slips, falls, muscular injury, collision, dehydration, exhaustion, equipment malfunction, or worsening of pre-existing health conditions.
All participants acknowledge that:

They voluntarily assume full responsibility for these risks.

Participation is undertaken entirely at their own risk.

Injuries (including serious injury or death) may occur despite safety precautions.
This acknowledgement is made in accordance with the Civil Liability Act 2003 (Qld), which recognises the Organiser’s right to limit liability for harm arising from obvious or inherent risks of recreational activity.
3. Medical Fitness to Participate
By participating in this event, individuals warrant that:

They are medically and physically fit to take part.

They do not suffer from any condition that could compromise their health or the safety of others.

They will immediately notify event staff if they feel unwell, unsafe, or experience injury during the event.
4. Release, Waiver & Indemnity
To the fullest extent permitted by law, all participants:

Release and discharge the Organiser (VPA Australia Pty Ltd), its directors, employees, volunteers, sponsors, venue owners (SWT Society), agents, and affiliated partners from all claims or liability for personal injury, illness, loss, damage, or expense incurred as a result of participation, including due to negligence.

Indemnify and hold harmless the Organiser and its affiliates against any claim, loss, or damage arising from their actions, omissions, or breach of this policy.
This release applies to both known and unknown claims and remains in effect indefinitely.
5. Recreational Activity Notice (Australian Consumer Law)
Under Section 139A of the Competition and Consumer Act 2010 (Cth) and relevant provisions of the Australian Consumer Law, participants acknowledge:

This event constitutes a recreational activity involving significant physical exertion and risk.

Certain consumer guarantees may be excluded for services related to such activities.

By accepting these terms, participants agree to the exclusion of such guarantees to the extent permitted by law.
6. Photography & Media Consent
Participants grant VPA Australia Pty Ltd and its authorised partners unrestricted rights to capture, reproduce, and use photographs, video footage, or other media taken during the event for any promotional, commercial, or marketing purposes, in perpetuity and without compensation.
7. Event Cancellation & Refund Policy

Entry fees are non-refundable under any circumstances, including withdrawal by the participant.

In the event of cancellation or postponement due to circumstances beyond the Organiser’s control (including but not limited to extreme weather, safety risks, venue closure, or public health directives), the Organiser reserves the right to cancel, postpone, or alter the event format without compensation.
8. Governing Law
This agreement is governed by the laws of Queensland, Australia. Any disputes arising under this waiver shall be resolved exclusively in the courts of Queensland.
9. Final Acknowledgement
By completing registration or entering the venue on event day, all participants confirm they have read, understood, and agreed to these terms, and acknowledge that this waiver is legally binding.
